ENR 5.1 PROHIBITED, RESTRICTED AND DANGER AREAS

1 DEFINITIONS

1.1. Each airspace in which a potential hazard to aircraft may exist and all areas over which the operation of civil aircraft may for any reason be restricted either temporarily or permanently are classified according to the three following types of areas:
PROHIBITED AREA – an airspace of defined dimensions, above the land areas or territorial waters of the Republic of Poland, within which the flight of aircraft is prohibited.
RESTRICTED AREA – an airspace of defined dimensions, above the land areas or territorial waters of the Republic of Poland, within which the flight of aircraft is restricted in accordance with certain specified conditions.
DANGER AREA – an airspace of defined dimensions within which activities dangerous to the flight of aircraft may exist at specified times.

2 LATERAL LIMITS

Each area is as small as possible and shaped by simple geometrical limits such as circle, triangle, polygon, etc.

3 NUMBERING

3.1. Each area is numbered. Separate series of numbers are used for all particular area types.
3.2. The identification is composed of the following groups of letters and digits:
  • EP - nationality letters from ICAO Doc 7910,
  • letter determining the type of area where:
    • P for prohibited areas,
    • R for restricted areas,
    • D for danger areas,
  • area number and the letter if segments are divided.
For example:

EPP1, EPP6, EPR1, EPR6, EPR21, EPD21, EPD53A etc.
 
3.3. To avoid mistakes, identification numbers of withdrawn areas are not used for identification of new areas for at least one year from the time of withdrawal.

4 PROHIBITIONS AND RESTRICTIONS ON FLIGHTS

4.1. Exceeding the speed of sound or flying at supersonic speeds is prohibited:
  1. at FL300 and below;
  2. within the whole airspace between 2100-0500 (2000-0400) UTC (see GEN 2.1).
4.1.1. The prohibition of exceeding the speed of sound or flying at supersonic speeds does not apply to ALFA SCRAMBLE flights.
4.2. Prohibition of flights within P areas (ENR 5.1.1).
4.2.1. The prohibition of flights within P areas is not applicable to:
  1. GARDA or ALFA SCRAMBLE flights;
  2. flights carried out in order to provide help in case of human or animal life or health hazard, especially in the events of natural disasters, catastrophes, environmental threats or emergency circumstances;
  3. flights carried out at the request of the manager of an entity protected by a P area;
  4. flights related to flight-checks of ground-based aeronautical facilities.
4.2.2. The prohibition of flights within EPP13 OLESNO does not apply to flights carried out to perform tasks for Polish Armed Forces.
4.2.3. The prohibition of flights within EPP21 WARSZAWA II does not apply to flights of state aviation.
4.2.4. Intended flights within a P area, excluding flights referred to in item 4.2.1, a) and b) shall be notified to the Polish Air Navigation Services Agency (e-mail: asm1@pansa.pl) not later than 24 HR before their intended conduct.
REMARK
The notification shall be made on the working day preceding the day of intended flight and not later than 1200 (1100) UTC (see GEN 2.1).
4.2.5. The president of the Civil Aviation Authority shall publish the list of operators of entities protected by a P area (including details of their address and website if available) by notice in the Official Journal of the Civil Aviation Authority.
4.3. Prohibition of flights within D areas (ENR 5.1.3)
On the dates of activity of these areas laid down in accordance with the provisions of ICAO Annex 15 published in the AUP or UUP and by NOTAM.
4.3.1. The prohibition of flights within D areas does not apply to:
  1. GARDA or ALFA SCRAMBLE flights;
  2. flights carried out in order to provide help in case of human or animal life or health hazard, especially in the events of natural disasters, catastrophes, environmental threats or emergency circumstances;
  3. flights carried out at the request or with the permission of the relevant unit controlling dangerous activities within a D area;
  4. flights related to flight-checks of ground-based aeronautical facilities.
4.3.2. Contact details of the unit controlling dangerous activities within a D area are made available by AMC Poland.
4.4. Restriction of flights within R areas in accordance with conditions specified in table (ENR 5.1.2)
4.4.1. The prohibition of flights within R areas, excluding EPR40 SŁUPSK, shall not apply to:
  1. GARDA or ALFA SCRAMBLE flights;
  2. flights carried out in order to provide help in case of human or animal life or health hazard, especially in the events of natural disasters, catastrophes, environmental threats or emergency circumstances;
  3. flights carried out in accordance with approach and departure procedures specified in manuals of aerodromes and airfields contained in the register of airfields that are located within these areas or when a procedure cannot be carried out without entering these areas;
  4. flights related to monitoring the condition of aeronautical obstacles;
  5. flights carried out at the request of the manager of an entity or area protected by an R area;
  6. flights carried out by military aviation aircraft as part of state celebrations provided that:
    • they have been agreed with the relevant ATS unit,
    • they maintain such a height as will permit, in the event of an emergency arising, a landing to be made without undue hazard to persons or property on the surface;
  7. flights related to flight-checks of ground-based aeronautical facilities.
4.4.2. The flying prohibitions within EPR40 SŁUPSK shall not be applied to flights conducted upon approval referred to in Article VII Paragraph 3 of the Implementing Arrangement between the Government of the Republic of Poland and the Government of the United States of America to the Agreement between the Government of the Republic of Poland and the Government of the United States of America Concerning the Deployment of a Ballistic Missile Defence System in the Territory of the Republic of Poland Regarding Use of Land Areas and Airspace Surrounding the Ballistic Missile System Base, signed in Warsaw on 27 April 2015 (Journal of Laws of 2016 Item 234), including flights for assistance in cases of life- and health-threatening emergency.
REMARK
As stated in the Arrangement the flying prohibition shall not apply to flights of state aircraft and flights of medical evacuation aircraft upon approval of the U.S. and Polish commanders of the Ballistic Missile System Base or their designated representatives.

4.4.3. Intended flights within an R area, excluding flights referred to in item 4.4.1, a) and b) shall be notified to the Polish Air Navigation Services Agency (e-mail: asm1@pansa.pl) not later than 24 HR before their intended conduct.
REMARK
The notification shall be made on the working day preceding the day of intended flight and not later than 1200 (1100) UTC (see GEN 2.1).
4.4.4. The president of the Civil Aviation Authority shall publish the list of operators of entities protected by an R area (including details of their address and website if available) by notice in the Official Journal of the Civil Aviation Authority.
4.5. Prohibition of flights over urban areas within their administrative limits as follows:
  1. urban areas whose number of inhabitants is from 25 000 to 50 000 – at a height of less than 500 m AGL for helicopters and piston-engine aeroplanes and less than 1000 m AGL for aeroplanes equipped with other engines,
  2. urban areas whose number of inhabitants is from 50 000 to 100 000 – at a height of less than 1000 m AGL,
  3. urban areas whose number of inhabitants is above 100 000 – at a height of less than 1500 m AGL,
  4. the City of Warsaw – at a height of less than 2000 m AGL.
4.5.1. The prohibition of flights is not applicable to:
  1. GARDA or ALFA SCRAMBLE flights;
  2. flights carried out in order to provide help in case of human or animal life or health hazard, especially in the events of natural disasters, catastrophes, environmental threats or emergency circumstances;
  3. flights carried out in accordance with approach and departure procedures specified in manuals of aerodromes and airfields contained in the register of airfields that are located within these areas or when a procedure cannot be carried out without entering these areas;
  4. flights related to monitoring the condition of aeronautical obstacles;
  5. flights carried out at the request or with the permission of a mayor;
  6. flights carried out by military aviation aircraft as part of state celebrations provided that:
    • they have been granted permission from a mayor,
    • they have been agreed with the relevant ATS unit,
    • they maintain such a height as will permit, in the event of an emergency arising, a landing to be made without undue hazard to persons or property on the surface;
  7. flights related to flight-checks of ground-based aeronautical facilities.
4.5.2. Intended flights over urban areas, excluding flights referred to in item 4.5.1, a), b) and c) shall be notified to the Polish Air Navigation Services Agency (e-mail: asm1@pansa.pl) not later than 24 HR before their intended conduct.
REMARK
The notification shall be made on the working day preceding the day of intended flight and not later than 1200 (1100) UTC (see GEN 2.1).
4.6. Prohibition of flights over military aerodromes and aerodrome infrastructure and facilities located at aerodromes within the physical boundaries of military aerodromes in the case of inactive MCTR.
4.6.1. The prohibition of flights is not applicable to:
  1. GARDA or ALFA SCRAMBLE flights;
  2. flights carried out in order to provide help in case of human or animal life or health hazard, especially in the events of natural disasters, catastrophes, environmental threats or emergency circumstances and flights indicated as HEAD or STATE;
  3. flights carried out in accordance with approach and departure procedures specified in manuals of aerodromes and airfields contained in the register of airfields that are located within these areas or when a procedure cannot be carried out without entering these areas;
  4. flights carried out at the request or with the permission of a military aerodrome operator.
4.7. Flights by unmanned aerial vehicles and remotely controlled model aircraft under VLOS may be conducted in geographical zones, flight rules, procedures and geographical zones descriptions can be found at www.pansa.pl in the tab „drony” (available in Polish language only).
  1. within an UAS geographical zone DRA-R D area with the permission and for the operator of a given area under conditions specified by the operator;
  2. within an UAS geographical zone DRA-R R area including airspace located directly above the area of a national park with the permission of the manager of a given national park and under conditions specified by the manager;
  3. within an UAS geographical zone DRA-R P with the permission of the manager of an entity falling within the given area and under conditions specified by the manager, except for aircraft with MTOM not exceeding 0.9 kg in case of flights conducted at a distance longer than 500 m from the ground of the entity protected by the P area up to a height of not more than 30 m.
